Legal US Sports Betting Revenue, Handle And Tax Totals Since PASPA Repeal

The U.S. gambling industry, including casinos, lotteries, and daily fantasy sports sites, scored a monumental win in May 2018 when the U.S. Supreme Court overturned the Professional and Amateur Sports Protection Act of 1992. That opened the floodgates to state-by-state legalization and regulation of sports betting.

Previously, single-game sports wagering was confined to the state of Nevada, and Las Vegas became the mecca of U.S. sports betting. However, legal sports wagering has expanded to more than 25 states and counting as of 2022 and is showing no signs of slowing down anytime soon. The American Gaming Association previously estimated that sports bettors in the U.S. were wagering $150 billion annually, prior to the overturning of PASPA, yet only about $5 billion of that was happening legally — in Nevada.

Some states have legalized only brick and mortar (B&M) sportsbooks for now, while others have also permitted online/mobile wagering; demand has been enormous and some states have seen as much as 90% of all bets in the state placed via online/mobile.

Below is a look at reported figures by legal markets in the exploding U.S. market, now more than four years since PASPA fell. Keep in mind that some states report robust information regarding legal wagers, while in others, data is sparse.

Legal U.S. sports betting revenue figures

The following table shows the sports betting handle (total dollars wagered), sportsbook revenue (gross revenue produced by legal sportsbooks, collectively, and adjusted when applicable), hold percentage across all sportsbooks in the state (percentage of dollars wagered the sportsbooks “kept,” producing the revenue), and state taxes collected.

Details for each state follow in individual sections below. You can click on the state in the below table to go directly to that state’s section. Note that state taxes indicates only taxes that the state ultimately receives, excluding local municipal taxes and certain administrative fees. The figures date back to May 2018, the month that the U.S. Supreme Court struck down the 1992 federal ban on full-fledged sports wagering outside Nevada.

Arizona sorts betting totals

Arizona market snapshot

Arizona completed a rather speedy process from governor’s signature to approval with its launch before the start of the NFL season in September 2021. Governor Doug Ducey and the state legislature were able to craft a bill that included tribal gaming interests as well as professional teams as both were able to obtain mobile and retail sports wagering licenses. The Arizona Department of Gaming has issued 18 of the state’s 20 potential licenses, and there are currently more than 15 different operators accepting wagers online in the state. The first six months showed there was a sizable appetite for sports betting as handle totaled nearly $2.8 billion.

Arkansas sports betting was made possible by voters, who approved Issue 4 in the 2018 November elections by a margin of 54.1-45.9 percent. Issue 4 provided the initiative to authorize casinos in five counties in the state that included three existing venues and two that will be built. Oaklawn Racing Casino was the first to accept wagers in July 2019, and Saraceno Casino Resort followed suit two months later. Southland Casino Resort was the third to start taking wagers in January 2020, and the two remaining casinos are slated for Pope and Jefferson counties. Arkansas approved mobile wagering to ring in 2022 with a controversial revenue-sharing model that has not been looked at kindly by operators. Betly Sportsbook was the first online platform to launch in the state, going live in April 2022.

Colorado sports betting was made possible by ballot referendum in November 2019, when the measure to legalize narrowly passed by 1%. The industry and player-friendly regulations to follow have resulted in what’s basically a robust test market for all groups looking to gain a foothold in the U.S. market — including Circa Sportsbook and the SuperBook, two of the Las Vegas-based titans. There may be up to 33 online sportsbooks available, one for each casino, and one physical lounge at each property. The first NFL team/sportsbook partnership was also struck in Colorado, when the Denver Broncos and FanDuel Sportsbook hooked up in June 2020.

The Nutmeg State legalized sports wagering on May 19, 2021, by Gov. Ned Lamont and launched six months later on Oct. 19, but getting to that point was sometimes a painstaking process. Connecticut has a semi-hybrid approach in which the two key gaming venues in the state run by the tribes — Foxwoods (Mashentucket Pequot) and Mohegan — have teamed with DraftKings and FanDuel, respectively, with those compacts for Class III Gaming published in September. The Connecticut Lottery has paired with SugarHouse, run by Rush Street Interactive, for its online sports wagering offerings, and RSI will also have access to 15 off-retail locations throughout the state as part of a 10-year deal with the state lottery agency.

The First State was actually among four states (including Nevada, Oregon, and Montana that had limited sports wagering “grandfathered” under PASPA, allowing the Delaware Lottery to offer NFL parlay betting even after Congress passed the ban. Once PASPA was struck down, Delaware beat New Jersey to the punch, accepting the first straight bet outside Nevada on June 5, 2018. Online sportsbook apps are not yet legal in the state.

It took a while for the nation’s capital to get going after the D.C. Council legalized it in December 2018 and Mayor Muriel Bowser signed the measure into law in January 2019. The first bets through the city’s mobile app, GambetDC, run by DC Lottery, were not made until May 2020. The road to launch had a series bumps and hiccups, and many people ultimately were not thrilled with the GambetDC platform and offerings. Bookmaker William Hill entered the field in August 2020, with a physical sportsbook at Capital One Arena — the first sportsbook to operate at a sporting venue in the United States. BetMGM recently followed suit with a retail location at Nationals Park, which officially opened its doors on January 31, 2022.

The first brick-and-mortar sportsbook in Illinois launched on March 9, 2020 at the Rivers Casino in Des Plaines, followed by the Argosy Casino Alton on March 12. The Illinois enabling legislation for sports betting originally required in-person registration for online betting accounts, though that expired on March 5, 2022. Mobile wagering has since taken off in the Land of Lincoln thanks to Gov. JB Pritzker’s Executive Order suspending the in-person provision, which he extended on multiple occasions throughout the COVID-19 pandemic in 2020 and into 2021. The first Illinois sportsbook to go live online was BetRivers Sportsbook through Rivers Casino, and there are currently seven total mobile operators accepting action in the state.

The first brick-and-mortar sportsbooks in Indiana launched shortly before the 2019 football season and online sportsbooks followed shortly thereafter. Betting handle has steadily increased each month following the resumption of sports post-COVID-19, and alongside it, as more sportsbooks came online, the percentage of legal wagers placed via mobile devices/online increased to roughly 90%. The Hoosier State is an open, competitive marketplace that we expect will continue to flourish.

Iowa was one of fastest moving states from legalization to launch, needing only three months. State sportsbooks launched retail and mobile on the same day. With the turning of the calendar to 2021, bettors in Iowa had remote registration available to open a mobile sports wagering account as the in-person provision expired at the end of 2020. Since the COVID-19 pandemic has subsided, Iowa’s handle has grown steadily. The Hawkeye State topped $250 million for the first time in October 2021.

Louisiana was able to launch retail sports betting within one calendar year after voters approved it on a parish-by-parish basis in a November 2020 referendum. Overall, 55 of the state’s 64 parishes approved sports wagering, and thanks to geofencing technology, mobile wagering will be able to be conducted where approved. Hurricane Ida, however, slowed the path for launching mobile wagering as the Louisiana State Patrol is in charge of the vetting process for operator applications. The Pelican State finally managed to roll out mobile sports betting on January 28, 2022 with nationwide leaders such as FanDuel, DraftKings, Caesars, and BetMGM getting the party started. The state is now home to seven different mobile sportsbooks and should continue to carve out its digital gambling community as time progresses. Each of the state’s 20 casinos/racinos can operate up to two mobile sportsbook brands apiece under their licenses, opening the possibility for up to 40 brands to eventually launch in Louisiana!

Maryland sports betting totals

Maryland voters legalized sports betting via referendum on a simple “yes” or “no” question in November 2020, and Gov. Larry Hogan signed a sports betting measure into law in May 2021. While there have been fits and starts moving forward, retail sports wagering did launch before the end of the calendar year in early December 2021. That will be the lone source of wagering for much of 2022 as the regulatory progress for mobile wagering is going at a much slower rate than retail. There is plenty of appetite for wagering as the law allows for up to 60 sportsbook licenses in Maryland, with a focus on “lens of inclusion” offering opportunities for women-owned and minority-owned sportsbooks to enter the marketplace. There are 13 entities that will be able to offer a mobile sports betting skin with their license, including the Baltimore Ravens, Baltimore Orioles, and Washington Commanders, and there will be incentive to get them up and running quickly considering the Old Line State is surrounded by states and jurisdictions already offering sports betting in Virginia, Pennsylvania, Delaware, and West Virginia.

Sports betting is now legal in the great state of Michigan. After a surprising veto by outgoing Governor Rick Snyder in December 2018 of a bill that had bipartisan support, lawmakers were able to seal the deal with Snyder’s successor Gretchen Whitmer in December 2019. Sports betting is allowed at all three of Detroit’s commercial casinos, and legislators were able to work in tandem with tribes across the Great Lakes State as well. In total, 20 of the state’s 26 casinos now offer retail sports betting in some form. A little less than one year after its retail sports betting debut, the Wolverine State launched online sports wagering en masse on January 22, 2021.

Mississippi was one of a handful of states able to offer legal sports betting without passing new legislation, having preemptively legalized in 2019, contingent upon federal law changing (which it did). The state’s gaming commission oversees commercial casinos, and there are also a handful of tribal venues. But Mississippi is viewed in the industry as a somewhat untapped market — statewide mobile isn’t legal, so betting is limited to on-site only.

Montana market snapshot

Run by the Montana Lottery, sports betting has been in available since March 2020. Sports wagering was made legal in March 2019 with the passage of House Bill 725 — the Sports Wagering Lottery Amendment Act of 2019 — which established the state lottery as the sole operator for sports betting. Though sports betting can be done via smartphone, bettors must be on-site at a lottery location in order to place wagers through Sports Bet Montana. People, though, can use the app to set up their accounts — which includes depositing and withdrawing funds, setting bet limits and preparing bet slips. The Montana Lottery sports betting platform is powered by Intralot.

Nevada market snapshot

Nevada has had legal sports betting since 1949, but lags behind more recent entries by requiring in-person registration for mobile accounts. Blame this on hospitality — many large resorts house sportsbooks and want to see patrons walk through the door and spend money on food or other gaming while registering for an account. New Jersey topped Nevada in handle in May 2019, less than one year after New Jersey sportsbooks took their first bets. New Jersey has remote registration, and mobile handle accounts for more than 90% of the total.

New Hampshire sports betting totals

New Hampshire legalized sports betting and appeared headed toward offering an open, competitive marketplace, as the enabling legislation permits up to 10 unique online sportsbooks. However, after the request-for-proposal phase, the New Hampshire Lottery opted to give DraftKings Sportsbook a monopoly on both retail and mobile sports betting. DraftKings offered the state a sweet deal on tax revenue to get the monopoly, but bettors now only have a single option. DraftKings launched its mobile app in late December 2019, and handle reached a high of $22 million before sports went on hiatus due to the COVID-19 crisis. The state collects a hefty 51% of gross gaming revenue as part of a deal for DraftKings to be the only operator in the state.

New Jersey sports betting totals

Every other “legal” state owes a debt of gratitude to New Jersey, which led the fight against PASPA and finally claimed victory in 2018. Very quickly after the Supreme Court ruling, New Jersey passed its new law formally legalizing sports betting and establishing rules and regulations. New Jersey’s open, competitive market has proved a huge success and a model for other states. After only four years, the Garden State has established itself as a friendly rival to Nevada in both market size and sportsbook innovation and became the first state to post a $1 billion monthly handle and at least $100 million in monthly operator revenue. New Jersey sportsbook lounges are open at many Atlantic City casinos, while the most popular sportsbook is a FanDuel lounge at the Meadowlands Racetrack adjacent to MetLife Stadium, about eight miles from New York City.

New York sports betting totals

It’s complicated. An economic/gaming law passed in 2013 preemptively approved land-based sportsbooks at upstate casinos. One of former Gov. Andrew Cuomo’s final acts before his resignation was to get the framework in place for mobile wagering. While many blanched at the 51% tax rate, every operator knew it could not risk potentially missing out on the vast New York market and applied. The result? Nine operators were approved as part of two super bids in which rivals became allies of convenience. The New York State Gaming Commission moved in rapid-fire fashion through the fall to launch during the first full weekend of 2022 with four operators — BetRivers, Caesars, DraftKings, and FanDuel — able to accept wagers. BetMGM, PointsBet, WynnBET, and Resorts World Bet have since commenced operations, and Bally Bet will eventually complete the field.

Oregon sports betting totals

Oregonians can bet on professional sports online via the Lottery’s ScoreBoard app or in person at either the Chinook Winds Casino Resort or Spirit Mountain Casino. Oregon was one of four states that were grandfathered in under PASPA to have sports betting, and the Lottery took advantage by developing ScoreBoard, which was its first foray into an online business. Looking for similar success it enjoys in New Hampshire, DraftKings now serves as the odds provider to the Oregon Lottery as of 2022. The tribe that owns the Chinook Winds Casino was allowed to reopen its compact with the state to add sports betting, but not all tribes are in the same situation. There is no tax rate on sports betting in Oregon, per se, as the Lottery is a state-run venture and states cannot “tax” tribal gaming.

Rhode Island sports betting totals

Rhode Island was quick to legalize sports betting after PASPA fell, but there’s no competition in the market — the state Lottery is the regulator and has a monopoly. Sports betting is available in person at two casinos, and online through a lottery-run platform, Sportsbook RI, which is associated with both the Twin River Casino and Twin River Tiverton. The deal for the casinos is that they pay the state 51% of gross gaming revenue, while the state provides more support and equipment than regulators do in other states. Essentially, the casinos and online books are Lottery outposts.

South Dakota sports betting totals

South Dakota executed a quick turnaround to launch sports betting in September 2021 just before the start of the NFL season. Voters had approved sports wagering on a retail-only basis the previous November for casinos in Deadwood — the town made famous by the HBO series and lead character Al Swearengen. Governor Kristi Noem signed SB 44 into law in March, creating a framework for sports wagering, and rules were approved in August before a slight tweaking the day before launch. Mobile wagering is allowed through an operator app, but only on the physical grounds of the casino.

Tennessee was the first state to offer exclusively online sports wagering, later to be joined by both Virginia and Wyoming. Sports betting became law in May 2019 when Gov. Bill Lee opted not to sign the Sports Gaming Act after it had been approved by legislature. Rick Staples had pre-filed House Bill 1 in November 2018, and it successfully navigated both bodies of legislature in the Volunteer State. Given its unprecedented status as an online-only market, the Tennessee Education Lottery Corporation took a deliberate pace in crafting its sports wagering rules. One unique rule is that sportsbooks must retain at least 10% of the hold in the form of revenue on an annual basis or be subject to fine. The Volunteer State went live with four operators on Nov. 1, 2020, with one of them — Tennessee Action 24/7 — a local outfit that operates exclusively inside Tennessee’s borders.

Virginia put together a fairly quick timeline in moving from legalized sports betting in March 2020 to accepting its first wagers in January 2021. It joined Tennessee (and later Wyoming) as the only states to conduct digital-only sports betting as four operators went live during the first month of the year. In its initial revenue report, Virginia showed promise with upside as it generated nearly $59 million in handle in just 11 days — and delivered on that potential by clearing $3 billion in wagers in its first full year. More operators have since entered the market, creating robust competition for lovers in Virginia who also love betting.

West Virginia sports betting totals

West Virginia market snapshot

West Virginia is another state that legalized in anticipation of the fall of PASPA, but it did so with lots of plot twists and intrigue. Gov. Jim Justice is a part-owner of The Greenbrier Resort, which hosts a PGA Tournament and now offers retail and digital sports betting. Justice pushed for a payout (“integrity fee“) to the leagues to no avail. The state’s first digital sportsbook went live in December 2018, only to be shut down ahead of March Madness in 2019 due to a contract dispute. After the rocky start, eight mobile books are currently operating, including industry leaders such as FanDuel, DraftKings, and Caesars.

Wyoming Sports Betting Totals

Wyoming was the first state to legalize sports betting in 2021 when Gov. Mark Gordon signed HB 133 into law in early April. The Equality State was fairly quick to get to market, accepting its first wagers in September as DraftKings and BetMGM were the first sportsbooks to operate in-state. A fully digital state, Wyoming also became the first state to allow bettors to fund their accounts via cryptocurrency, and operators are required to have a reserve account that is in a bank in the state or chartered by the state. Big Wyoming has a 10% tax rate on revenue and allows wagering on professional, college, and Olympic sports.
